The Dangers of Standard Mirror Wills
Most Couples have Standard or “Mirror” Wills, more than likely set up some time ago, leaving all their wealth to their spouse and then on to their children absolutely.
This puts your hard earned wealth at risk from a number of threats..
You may want your surviving spouse to potentially move on at some stage, however you need to understand what happens to these simple wills you established together if you passed away and your spouse later remarries.
A will is automatically revoked once someone gets married or in this case re-marries. If your spouse then died first before re-drafting a new will they may inadvertently leave all or most of your remaining estate to their new partner, and then to his or her children, not your own children.
Even if neither of you remarry and you do end up leaving your money to your children their inheritance is at risk if they themselves Divorce, remarry, or get into some form of financial difficulty. Hardly what you had planned.
If you or your spouse (or later your children) have a need for care then that wealth, including your home, could well be taken by the local authority to fund the growing cost of care.
Writing a will that leaves money to a simple trust can ensure that your Wealth reaches your intended beneficiaries and stays in your family for generations to come.
This protects the wealth you have created being at risk from creditors, ex-spouses and local authorities using established methods which have been around for many, many, years, unfortunately just not something your solicitor has bothered to recommend and now available to all families, no longer just the super-wealthy.
We are happy to explain how this works at a convenient time in the comfort of your own home or place of work.
Business owners also need to ensure that valuable reliefs are not forfeited if one or two vital paragraphs are overlooked.
